Dashcams erfreuen sich steigender Beliebtheit und auch in Deutschland sind immer mehr Autofahrer mit der kleinen Kamera auf Armaturenbrett oder Windschutzscheibe unterwegs. Der Name setzt sich aus den englischen W\u00f6rtern \u201edashboard\u201c (Armaturenbrett) und “camera” zusammen und viele Autofahrer halten diese f\u00fcr durchaus sinnvoll. Laut einer Umfrage des IT-Branchenverbandes Bitcom nutzen bereits 8% der deutschen Autofahrer eine Dashcam, Tendenz stark steigend. Aber Achtung: Das permanente Aufzeichnen mit einer solchen Kamera bleibt unzul\u00e4ssig!<\/em><\/p>\n

Mit dem Urteil hatte die Revision eines Autofahrers aus Sachsen-Anhalt Erfolg. Dieser wollte mithilfe der Aufnahmen seiner Dashcam seine Unschuld bei einem Verkehrsunfall beweisen. Amts- und Landgericht verwiesen auf Datenschutzbestimmungen und das Beweisverwertungsgebot, der BGH jedoch hob dieses Urteil nun auf. Die Aufnahmen verstie\u00dfen zwar gegen das Datenschutzrecht, da die Beteiligten aber sowieso Angaben zu Person, Versicherung etc. machen m\u00fcssen, sei dies nachrangig einzustufen. Beim vorliegenden Fall kam noch dazu, dass weder Sachverst\u00e4ndige noch Zeugen den Unfallhergang hinreichend aufkl\u00e4ren konnten.<\/p>\n

Das BGH-Urteil bedeutet jedoch nicht, dass man permanent filmen darf. Das verletzt Datenschutzbestimmungen, weil \u00f6ffentlicher Raum st\u00e4ndig gefilmt und damit das allgemeine Pers\u00f6nlichkeitsrecht von Verkehrsteilnehmern verletzt wird. Diese grunds\u00e4tzliche Unzul\u00e4ssigkeit f\u00fchrt aber nicht dazu, dass die Aufnahmen in Zivilprozessen nicht genutzt werden d\u00fcrfen. Entscheidend ist der Einzelfall und die entsprechende richterliche Abw\u00e4gung dazu.<\/p>\n

Eine Frage von Dauer<\/h4>\n

Der Einsatz einer Dashcam bleibt also nach wie vor \u201eknifflig\u201c. Eine Kamera, die mit dem Drehen des Z\u00fcndschl\u00fcssels erwacht und permanent filmt, verst\u00f6\u00dft nach wie vor gegen bestehende Gesetze. Im Grunde kann aber nur eine solche Variante im Fall der F\u00e4lle f\u00fcr Aufkl\u00e4rung sorgen, denn niemand sieht in Sekundenbruchteilen eine Gefahrensituation voraus und schaltet dann auch noch in Ruhe die Kamera ein.<\/p>\n

F\u00fcr bestimmte (Gefahren-) Situationen aber kann eine Kamera im Kfz durchaus Sinn machen \u2013 eine solide Halterung und eine schnelle, bequeme Bedienung sind dann entscheidend. Eine GoPro<\/a> kann also definitiv als Dashcam-Variante eingesetzt werden und macht in Anbetracht der aktuellen Gesetzeslage sogar durchaus Sinn.
